Request for Spring Hunt Test Applications - Tuesday, December 23, 2008
The APLA hunt test committee is calling for spring hunt test applications The application's due date is January 20th. The application form is found under the EVENTS tab, then click on the HUNT TEST tab, and then down load the application form. Complete the form as fully as possible. Don't be concerned with your judges until applications are approved and date is set. Here is a question I have been wondering as of late. Would you honor a hip/eye guarantee even if the dog's owner did not use your kennel name on the registered name and with no hesitation the owner spayed or neutered the dog?

I'm not a breeder, but without a doubt, my answer would be YES. (as long as it was within the "guarantee period" in the contract).

If you had it in the contract that he needed to use the kennel name it would void the warranty if thats the way you put it!

In order for it to be considered a "contract," the document would have to contain the above stated clause, and both the kennel owners name/signature and the buyers name/signature. I am not too familiar w/ most outfits, but I know when I purchased my pup, I only have the kennels written guarantee w/ the kennel owners signature. Anyway, I think a GUARANTEE is just that....a guarantee. The good news is my lawyer buddies can always afford to join me on our annual elk hunt to Colorado.

If the guarentee is in writing and both breeder and buyer had signed it, and with one of the conditions was that you must have kennel name in registered name, then probably not. BUT if the breeder didn't have you sign a guarentee then I would say that you are entitled to at least another puppy or price reduced on a similar breeding.
Guess I may think differently than other breeders but having your kennel name in the registered name of a buyers dog is really not that important.....for the simple fact is that when your dog accomplishes or obtains titles the first question out of a on looker is "WHO IS THAT DOG OUT OF?"
So with that said....if you didn't sign a guarentee or the breeder didn't offer a written guarentee then I would say that you entitled to another pup of similar caliber!

The case that comes to mind there was no contract nothing on paper, just a gentleman's agreement. I guess if I were to produce a pup that did not meet the gurantee, I would work something out with the owner, most likely a pup out a similar breeding.

A gentlemens agreement, too bad they are few and far between. I agree w/ you, the breeder has an obligation to FIX his problem. Its not his fault that the dog didn't pass, but if he tries IN ANY WAY to re-nig on his guarantee, he's a dirtball first-off, second he'd be on his way to court, and third his name would be mud everywhere I could post it. He could sue me, but he'll have to prove I stated a NON-TRUTH and it would already be too late. Isn't it too bad that a man's word is worth nothing anymore.

When I purchased my last pup the breedertold me he had an unconditional guarantee. I could return the dog for any reason. No its not in wrighting. If he tried to back out on his word I wouldnt put his shortfall in wrighting either. However I am entitled to speak the truth and if the truth was he didnt honor his words then my words would express that to whom ever may ask.
